By accessing or using UnityFreak ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and UnityFreak. We may update these Terms from time to time, and your continued use of the Platform after any changes constitutes acceptance of the revised Terms.
You must be at least 16 years of age to create an account on UnityFreak. By registering, you represent and warrant that you meet this age requirement and must provide your date of birth. If you are under the age of 18, you must have the consent of a parent or legal guardian, which will be verified via email. Users under 18 cannot access freelance, marketplace selling, or employment features. All purchases require identity verification via Stripe Identity.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You must notify us immediately of any unauthorised use of your account.
You agree not to:
We reserve the right to investigate and take appropriate action, including suspending or terminating your account, for any violation of these Terms.
User-Generated Content. You retain ownership of content you create and upload to the Platform, including but not limited to forum posts, comments, project descriptions, articles, and profile information. By posting content, you grant UnityFreak a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute your content in connection with operating and promoting the Platform.
Source Code & Repositories. Repository content you push to UnityFreak's version control hosting is licensed to us solely to store, transmit, and display it back to you and those you grant access to — nothing more. We do not use repository content, in whole or in part, to train, fine-tune, or evaluate any artificial intelligence or machine learning model, whether ours or a third party's. We do not sell, rent, or otherwise disclose repository content to third parties. We do not scan repository content for any purpose beyond operating the service (for example, malware/abuse detection, backups, and the search and indexing features you use directly). This commitment applies to private, internal, and public repositories alike, on every plan including Free.
Courses & Educational Content. Course creators retain intellectual property rights to their course materials. UnityFreak is granted a licence to host and deliver the content to enrolled students. Enrolled users may not redistribute, resell, or share course content without the creator's permission.
Asset Marketplace. Assets listed on the marketplace are subject to the licence terms specified by the asset creator. Buyers receive the licence as described in the asset listing. UnityFreak does not claim ownership of assets listed by third-party creators.
Platform Content. All content created by UnityFreak, including but not limited to the Platform design, logos, text, graphics, and software, is the property of UnityFreak and is protected by intellectual property laws.
UnityFreak provides a marketplace that connects clients with freelancers and developers for project-based and employment engagements. UnityFreak acts as a platform facilitator and is not a party to any contract between clients and freelancers.
All clients and freelancers must complete identity verification through Stripe Identity before they can post jobs, apply for work, make purchases, or receive payments on the marketplace. This verification is required to prevent fraud and comply with anti-money laundering regulations. A one-time, non-refundable verification fee of $10 USD is charged at the time of verification. This fee covers the cost of identity checks and helps ensure the integrity of the marketplace.
Upfront Payment. When a client posts a job, they pay the full project price upfront via Stripe. A 10% platform service fee is deducted immediately by Stripe as an application fee and is non-refundable. The remaining funds are held in escrow by Stripe until milestones are completed. UnityFreak does not hold, control, or have access to escrowed funds — all funds are held and disbursed by Stripe in accordance with Stripe's terms of service.
Projects are divided into milestones agreed upon by both parties. Once a freelancer begins work on a milestone, the corresponding escrow funds are allocated to that milestone. The milestone process is as follows:
Freelancer Abandonment. If a freelancer becomes inactive on an engagement for thirty (30) consecutive days without communication, Stripe will release payment for any completed milestones to the freelancer and refund the remaining balance to the client. The 10% platform fee is not refunded.
Client Abandonment. If a client becomes unresponsive for thirty (30) consecutive days without filing a dispute or requesting a refund, funds held by Stripe will be released to the freelancer for any completed milestones. Remaining escrowed funds will be retained by the platform. The 10% platform fee and any funds for completed milestones are non-refundable.
In the event of a dispute between a freelancer and a client, either party may file a dispute through the Platform. UnityFreak may offer mediation at its discretion but is not obligated to resolve disputes. Both parties agree to attempt to resolve disputes in good faith before seeking external remedies. Clients who wish to request a refund must file a dispute before the thirty (30) day inactivity period expires.
The marketplace also supports long-term and ongoing engagements. These follow the same model as project-based work — UnityFreak connects the parties and Stripe processes payments. The only difference is payment frequency:
UnityFreak charges a 10% service fee on all freelance and employment transactions. This fee is deducted from the client's or employer's payment at the time of posting or at each pay period and is non-refundable under all circumstances, including cancellation, dispute, or abandonment.
Payments on UnityFreak are processed through Stripe. By making a purchase or subscribing to a plan, you agree to Stripe's terms of service in addition to these Terms.
Platform Service Fee. UnityFreak charges a 10% platform service fee on all creator transactions, including course sales, asset marketplace sales, freelance projects, and employment facilitation. This fee is deducted at the point of sale and is non-refundable under all circumstances. Where a refund is issued, the refund amount is calculated on the post-fee balance only — the 10% platform fee is always retained.
Tax Obligations (Marketplace). UnityFreak operates as a marketplace facilitator, not as a Merchant of Record (MoR). This means:
Subscriptions. Subscription plans automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
Refunds. Refund eligibility depends on the type of purchase:
Refund requests can be submitted through your account settings or by contacting our support team. All refunds are processed via the original payment method through Stripe.
UnityFreak offers live streaming features for educational and community content. By using the streaming functionality, you agree to the following:
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the practices described in the Privacy Policy.
To the maximum extent permitted by applicable law, UnityFreak and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.
UnityFreak's total liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount you have paid to UnityFreak in the twelve (12) months preceding the claim. The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
We may suspend or terminate your account and access to the Platform at our sole discretion, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. You may also delete your account at any time through your account settings.
Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property provisions, limitation of liability, and dispute resolution.
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
If you have any questions about these Terms of Service, please contact us at [email protected].
UnityFreak respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We respond to valid notices of alleged copyright infringement and have adopted a policy for the removal of infringing content and the termination of repeat infringers.
Takedown Procedure. If you believe that content on the Platform infringes your copyright, you may submit a takedown notification to our designated DMCA agent. Your notification must include: identification of the copyrighted work, identification of the infringing material and its location on the Platform, your contact information, a statement of good faith belief that the use is not authorised, a statement under penalty of perjury that the information is accurate, and your physical or electronic signature.
Counter-Notification. If you believe your content was wrongly removed, you may file a counter-notification with our DMCA agent. Repeat Infringer Policy. UnityFreak will terminate the accounts of users who are determined to be repeat copyright infringers. We define a repeat infringer as any user who has received three (3) or more valid DMCA takedown notices. Account termination under this policy is permanent.
Designated DMCA Agent. DMCA notifications and counter-notifications should be submitted through our DMCA page or sent to [email protected].
You agree to indemnify, defend, and hold harmless UnityFreak, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:
This indemnification obligation will survive the termination of your account and these Terms.
UnityFreak uses Stripe Connect as its payment processor for all marketplace transactions, including freelance projects, employment payments, course sales, and asset sales. All funds are held and disbursed by Stripe — UnityFreak does not hold, control, or have direct access to any user funds at any point. UnityFreak does not act as a bank, financial institution, payment service provider, or escrow agent.
Platform Role. UnityFreak acts solely as a marketplace facilitator. UnityFreak is not a party to any freelance contract or employment arrangement formed through the Platform and assumes no liability for the performance, quality, or outcome of any engagement. UnityFreak's role is limited to connecting parties and instructing Stripe to process payments based on milestone completions and other platform events.
Stripe Terms. All payment processing, including escrow holds, disbursements, and refunds, is governed by Stripe's Terms of Service. By using payment features on the Platform, you agree to be bound by Stripe's terms in addition to these Terms.
Limitation. UnityFreak is not responsible for payment failures, processing delays, chargebacks, or any interruptions to Stripe's services. Disputes regarding payment processing should be directed to Stripe.
Informal Resolution. Before initiating any formal proceedings, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days. Most concerns can be resolved quickly through direct communication.
Mediation. If informal resolution is unsuccessful, either party may refer the dispute to mediation administered by the Centre for Effective Dispute Resolution (CEDR) under its mediation procedures. Mediation costs shall be shared equally between the parties unless the mediator directs otherwise.
Court Proceedings. If the dispute is not resolved through mediation within sixty (60) days of the mediation request, either party may bring proceedings in the courts of England and Wales in accordance with Section 18 (Governing Law).
Consumer Rights. Nothing in this section limits your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable consumer protection legislation. You always retain the right to bring claims in the courts of your country of residence where permitted by law.
By uploading, posting, or otherwise making content available on the Platform, you represent and warrant that:
UnityFreak reserves the right to remove any content that is believed to be in violation of these warranties without prior notice. Repeated violations may result in account termination under our repeat infringer policy.
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law principles. Subject to the dispute resolution process in Section 16, you agree to submit to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with the Privacy Policy, Cookie Policy, and Community Guidelines, constitute the entire agreement between you and UnityFreak regarding your use of the Platform. These Terms supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter hereof.
